2. Service Overview
MiddleGroundPortal offers exclusive yacht charter services that comprise:
- Rental of yachts on a daily basis
- Evening yacht cruises
- Business retreats
- Bespoke events
- Extended yacht charters
Availability and weather influence our services. We have the authority to alter or cease our services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To reserve a yacht charter, you are required to:
- Be no less than 18 years of age
- Provide true and complete details
- Make the necessary advance payment as outlined in your booking acknowledgment
- Consent to these Terms & Conditions
3.2 Confirmation
A confirmed booking is only established with the successful transaction of payment and our confirmation in writing. Service may be refused to anyone at our discretion.
3.3 Availability
Charter services depend on the availability of the vessel and suitable weather conditions. Efforts will be made to accommodate your preferred schedule.
4. Payment Terms
4.1 Pricing
All quoted costs are expressed in € and inclusive of relevant taxes unless stated differently. Prices may alter without prior notification.
4.2 Payment Schedule
- Deposit: 50% of the total cost of the charter required upon reservation
- Outcome Balance: Payable 48 hours before the charter departs
- Additional fees (as applicable): Payable upon charter conclusion
4.3 Payment Methods
Accepted forms of payment are major credit cards, electronic bank transfers, and approved cheques. Our payment processing utilizes secure, encrypted protocols.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- In excess of 72 hours prior to departure: refund in full minus administrative costs
- Between 24 to 72 hours before departure: 50% refund
- Less than 24 hours prior to departure: Non-refundable
5.2 Weather Cancellations
Should unsafe weather conditions arise as determined by our captain, options include:
- Rebooking your charter to an alternate date at no extra charge
- Issuing a total refund if rebooking is unfeasible
5.3 Vessel Complications
In the unlikely event of mechanical issues with the designated vessel, we will attempt to offer a boat of similar status. Should a replacement not be attainable, a complete reimbursement will be issued.
6. Safety and Conduct
6.1 Safety Regulations
All travelers must:
- Heed all directives from the crew
- Utilize safety attire as deemed necessary
- Disclose any health conditions that could impinge on their safety
- Stay within demarcated areas aboard the vessel
6.2 Restricted Items
Items not permitted aboard include:
- Containers made of glass
- Illicit materials
- Guns or any form of weaponry
- Excess refreshments beyond reasonable personal consumption
- Animals (except with prior consent)
6.3 Behavior
Passengers are expected to behave in a respectful manner. We retain the right to cut short a charter without a refund if any behavior by the passengers presents a safety hazard or interferes with the enjoyment of others.
7. Liability and Insurance
7.1 Our Responsibility
We shall only be liable to the extent of expenses incurred for your charter. We will not be liable for:
- Personal harm arising from passenger negligence
- Destruction or loss over personal belongings
- Indirect or punitive damages or consequential losses
- Delays due to weather or other factors outside our control
7.2 Insurance Agreements
We keep comprehensive marine insurance that covers our fleet and operations. Patrons should secure their travel and personal insurance independently.
7.3 Acceptance of Risk
By partaking in our charter solutions, you acknowledge the intrinsic hazards of marine activities and agree to accept responsibility for your safety and security.
8. Alterations to Itinerary
We retain discretion to adjust itineraries, travel routes, or timetables due to climatic conditions, safety concerns, or operational necessities. Efforts will be placed to offer suitable alternative arrangements.
9. Force Majeure
Exemptions from liability will be in effect for disruptions, modifications, or cancellations brought about by factors not within our control, inclusive of, but not confined to:
- Harsh weather elements
- Catastrophes of nature
- Legislative directives
- Shutting down of harbors
- Mechanical malfunctions
10. Privacy and Data Protection
We manage your personal data following our Privacy Policy. Utilization of our services indicates your agreement to the accumulation and application of your details as outlined within our Privacy Policy.
